GENERAL AGREEMENT :

This document states the terms and conditions of using this site. By using this site and submitting to an order, you are agreeing to the Terms and Conditions listed below. Professional Hair Care Products reserves the right to amend this site and the Terms and Conditions at any time.By registering and placing an order with Professional Hair Care Products, you give us permission to add your contact details to our database so we can send through correspondence that relates to ordering, invoicing, shipping , product reviews and ratings.

PRICING AND TAXATION

All pricing is stated in Australian Dollars (AUD$) and is GST inclusive. Professional Hair Care Products website and store prices are subject to change without notice. The current price of each product is shown on the website at the time the order is placed. The price of products on our website may differ from prices in store. Products available on sale online may sometimes only be available for purchase from the website and are not available for purchase in store or by phone order.

Professional Hair Care Products will not match any prices for any products that are available through the prohaircare.com.au website or Professional Hair Care Products stores or vice versa.

RETAIL AND TRADE SITES :

Professional Hair Care Products sells to both the public and hair and beauty professionals. Some products are exclusively Trade Only as stated by the Manufacturer. If you are qualified, or in training, within the Hair and Beauty Industry, you will need to register with the Trade Site before purchasing these products.

ORDER CANCELLATIONS :

If you wish to cancel your order, we will be happy to accommodate only if the order has not been shipped. If payment has already been made, we will gladly refund the amount charged by the method in which it was originally paid.

Prohair reserves the right to refuse order cancellation, or a cancellation fee will be charged equal to the actual cost of shipping to and from the original order destination, in the event that the order has already been dispatched, and only if we are able to request the return of the package from the courier company.If you wish to cancel your order, we will be happy to accommodate only if the order has not been shipped. If payment has already been made, we will gladly refund the amount charged by the method in which it was originally paid.

Professional Hair Care Products reserves the right to refuse order cancellation, or a cancellation fee will be charged equal to the actual cost of shipping to and from the original order destination, in the event that the order has already been dispatched, and only if we are able to request the return of the package from the courier company.

PAYMENT :

Payment can be made by Credit Card through PayPal or Nab Transact. Credit Card options include Visa and MasterCard. All payments made by Credit Card will have a pre-authorisation check to ensure sufficient funds are accessible and to confirm legitimacy of payment method. These funds will be frozen and the full amount charged will be taken out once the order has been despatched.

All Credit Cart Payments will state Prohair Pty Ltd as the receiver of monies taken from this site on your Bank Statement. Direct Deposit Details will be provided when chosen for payment method in the Checkout Process. They will also be present on the Order Confirmation that will be sent via email. Please use the Order Number as the Reference when making payment. Shipment of goods will not be made until full payment has been received.

DELIVERY :

All shipments are made with Express Couriers or Postage Services. Freight charges are stated within the Shipping Page and may change without notice. Orders placed after midday will be despatched the following business day.
If there is a problem with your order and we cannot fill it within this time frame, Prohair will contact you using the contact details that were provided in the ordering process. Please ensure that all details provided are up to date and current.
All delivery times stated on this site are estimated times only, and may vary.

Prohair will not be held liable for any late deliveries or any losses, damages, expenses, charges, or costs that may arise from the late delivery. On delivery, all orders require a signature before release of order. If you would like your parcel to be delivered without a signature, leave a special message in the ordering process. In this instance, Prohair will not be held responsible for any theft, loss or damage that may occur once delivery has been made by shipping provider and all responsibility from the point of delivery will be passed on to you.

Once the order has been released, you are responsible to check the order and inform Prohair of any damages or faults within 2 working days. Orders will be delivered to the Shipping Address that is stated in the Order Process. Please check this information is correct, as Prohair will take no responsibility for delivery to an incorrect address and/or any losses that may occur as a result.

WARRANTIES AND REPAIRS :

All warranties are supplied by the manufacturer and not that of Professional Hair Care Products. These warranties are offered by the manufacturer, who specify the warranty periods and may vary for each product. Professional Hair Care Products has no control over manufacturer warranty and repair periods and cannot advise what they will be. Therefore Professional Hair Care Products has no control as to the time frame. In saying that, Professional Hair Care Products will do all that it can to ensure that it is handled as quickly as possible, updating you through the process. If the faulty item cannot be repaired, a replacement or refund will be offered. Professional Hair Care Products cannot be held accountable when the faulty item is sent direct, or communications are made, from you to the manufacturer in the need of repair or a replacement.

RETURNS :

Please choose carefully. We do not normally give refunds if you simply change your mind or make a wrong selection. You can choose between a refund or exchange where goods are faulty and cannot be repaired, wrongly described, different from a sample shown to you or don’t do what they are supposed to do.
Please retain your original receipt as proof of purchase. All returns must be in original condition, unopened and unused (unless faulty). Returns must be made within 14 days of delivery, except when an item is faulty and covered by a warranty period.

It is the customer’s responsibility to retrieve any items that Prohair deem to be in unacceptable condition (unless faulty) or outside of the mentioned timeframe. Prohair will not pay to return items in unacceptable condition. Prohair takes no responsibility for lost items when sending returns, so we suggest that you send them via registered post.

Gift cards and promotional codes cannot be returned or exchanged and cannot be applied to exchanges. Once Prohair receives your returned item and deem it to be in an acceptable condition (unless faulty), we will happily refund or exchange it.

PROMOTIONAL OFFERS AND THEIR LIMITATIONS :

By using a promotional code, you agree to understanding the terms and conditions stated below. All promotional codes, offers and discounts advertised
online are for online use only and are valid for the specified time frame only. All promotional codes are one time use only unless otherwise stated.
All promotional one time only codes must be used in their entirety in a single purchase. For promotions where one or more items are required to be

purchased to receive a discount on a second item, the discount will be applied to the equal or lesser valued item.
Promotions requiring a minimum order amount will not include charges for shipping and credits for gift cards in the overall order amount. Prohair

reserves the right to terminate or continue any promotions at its sole discretion. Promotional codes cannot be applied to shipping, for purchase of eGift
cards, GST or any other such duties.
If you have reason to exchange or return an item where a promotional code was attached, the promotional code (if expired) can not be reused for

replacement or future orders. A credit/refund will be applied for the promotional price charged only.
Promotional items are only valid while stocks last. Prohair will not provide rain checks on items that have sold out.

Prohair will not be held responsible for any incorrect entry of promotional codes and will not be accountable for incorrect
charges or incorrect items ordered. Prohair has no obligation to advise the customer that incorrect or incomplete entry has taken place and is not required to return or

This document only addresses prohaircare.com.au activities from prohaircare.com.au servers and does not cover the terms and conditions of other sites, or of companies that prohaircare.com.au does not own or control, or the actions of people that prohaircare.com.au does not employ or manage.

IPHONE/IPAD/ANDROID APPLICATIONS :

If you access this site, via an application through mobile phone or tablet (an iPhone Application, for example), all terms and conditions stated on this page will apply. This application is currently free of charge, however your carrier’s rates and fees will still apply.

Any personal information that you provide in any content submitted when using our website interactive services like blogs, ratings/reviews and your products recommendations may be displayed on prohaircare.com.au, so please consider this before submitting any such content. Please don’t submit any information that you don’t want the whole world to know!

TYPOGRAPHICAL ERRORS :

Professional Hair Care Products reserves the right to refuse or cancel any orders where a product is listed at an incorrect price or with incorrect information due to a typographical error. This can occur even when an order has been confirmed and payment made. In the event that payment has already been made, Professional Hair Care Products will immediately credit the amounts charged.

DISCLAINER :

Professional use only products such as bleach, peroxide, colourants, wax products are to be used by qualified hair and beauty professionals only. All products are to be used in accordance to the product manufacturer’s guidelines. No responsibility will be accepted for misuse or incorrect selection of products.

TRADEMARKS & COPYRIGHTS :

This site is owned and controlled by Professional Hair Care Products. All operations and content have been Trademarked and copyrighted. All text, site design, logos, images etc are the exclusive property of Professional Hair Care Products and cannot be reproduced, modified, copied, uploaded etc for any purposes, unless specified in writing, signed by Professional Hair Care Products. Any unlawful use of material from this site may breach any copyright, trademark or other related laws and may result in criminal charges.

LIMITATION OF LIABILITY :

Professional Hair Care Products is not liable for any losses or damages incurred as a result from the use of this website or any website linked to or from this website.

GOVERNING LAW :

This Agreement shall be governed, construed, and enforced in accordance with the laws of the State of Victoria without regard to its conflict of laws rules.

COUPON EXCLUSIONS :

SHIPPING & DELIVERY :

Professional Hair Care Products works hard to get all of your orders out as soon as possible. We also offer our customers a free delivery option Australia wide! Please Note that we do not ship to International clients.

For postage-free delivery on orders placed on our website prohaircare.com.au, the order amount must be $300. This excludes furniture items. Our delivery providers deliver Monday to Friday, excluding Public Holidays.

Depending on which part of the country you are located, delivery times may vary. Public holidays in the state of Victoria will affect the dispatch and maybe the delivery of your parcel. So allow an extra day or two when ordering products around public holidays including ones in your home state.

PICK UP FROM STORE ORDERS :

Pick up from store items will incur a $6.00 picking fee due to our high volume of orders. Pick up orders placed on business days after 9:00am will be available the next available business day, Items ordered over the weekend will be available to pick up the next available business day. Please note that it is not Professional Hair Care Products responsibility to notify you about any pickup orders that ready for collection. Professional Hair Care Products will hold a pick up orders for a maximum of 5 business days before products are returned to the shelf. If the customer is to come into the store after this time frame, we will re pack the order and if a given product on that order is then out of stock you will receive a store credit up to the value of that given item.

PICK UP FROM STORE ORDERS :

Orders may only be picked up fromProfessional Hair Care Products Blackburn. Professional Hair Care Products retains the right to change the opening hours of its store at any given time. Operating hours that appear on days next to or alongside major Victorian & Australian events may mean that the Store is closed or has an altered operating time. Any changes to this will appear on our social media pages and on premises.
